On National Weed Day Texas Bans K2

Whoa, dudes, the Texas Legislature is harassing all the pot-head's mellow on National Weed Day. The Texas Department of State Health Services made the announcement today after the DEA had begun made it a federal crime for one year.

K2 is a synthetic marijuana that is marketed as a herbal incense. It creates psychoactive effects that are similar to those from smoking marijuana. State law requires the commissioner to either object to the ban or place the banned substance on the Texas Schedules of Controlled Substances. 

This drug is now going to be prosecuted under Section 481.119 of the Texas Controlled Substances Act. If the person knowingly manufactures, delivers, or possesses with intent to deliver K2, then he or she will be charged with a Class A Misdemeanor. If the person knowingly or intentionally possesses a controlled substance an offense under this section is a Class B Misdemeanor.
