What Is The Texas Controlled Substance Act?

The Texas Controlled Substances Act was enacted in 1989 to regulate controlled substances in Texas. This act mandates who regulates and classifies controlled susbstances in Texas. First, the Act defines a controlled substance as a "substance, including a drug, an adulterant, and a dilutant, listed in Schedules I through V or Penalty Groups 1, 1-A, or 2 through 4."

It is very, very important to remember that this "term includes the aggregate weight of any mixture, solution, or other substance containing a controlled substance." The reason that the Texas Legislature included this term was to allow prosecution of a person who possesses a controlled substance based on total weight--and the courts, prosecution, and jury do not have to be concerned with how much of the drug is actually a controlled substance or adulterants or dilutants.
