Texas does not prosecute possession of drugs only. In fact, Texas will prosecute a person for possession of drug paraphernalia. Thus, it is a separate criminal charge in Texas.
Texas classifies possession of drug paraphernalia as a Class C Misdemeanor. This carries a penalty of $500. Generally, if one is charged with a possession of controlled substance, then a possession of drug paraphernalia will be charged against the person, as well.
Texas law defines drug paraphernalia, interestingly, as ANY item that is used to process drugs, package drugs, grow drugs, prepare drugs, test drugs or any mechanism that can assist with consuming drugs. This includes very common household items that are used in association with drug consumption. These include spoons, bowls, baggies, or bowls.
