Plano Drug Crimes Defense Lawyer
Possession of a Controlled Substance
Possession of a controlled substance is a very serious charge, and a conviction could dramatically alter your future for years to come. If you or someone you know has been charged with possession of a controlled substance it is urgent that you consult with a quality Plano drug crimes defense attorney as soon as possible. From very early in the criminal law process, prosecutors might try to bully or coerce you into a confession or giving testimony before you are fully aware of your rights and legal options. Don't be fooled!
If Convicted of Drug Possession, What Punishments do I face?
The punishments for a drug possession conviction vary greatly depending on the quantity of the controlled substance, and the type (or penalty group) of controlled substance. It's important to note that even though a drug may be legal, it's illegal to possess them without a prescription. Marijuana is in a separate group, and you can read more about that on our Possession of marijuana page. Below is a general example of the Texas penalty groups
-
Group 1- Cocaine, heroin, methamphetamine, GHB, ketamine, oxycodone, and hydrocodone
- Group 1a- LSD
- Group 2- Ecstasy, PCP, mescaline
- Group 3- Valium, Xanax, and Ritalin
- Group 4- Compounds containing Dionine, Motofen, Buprenorphine, or Pryvalerone

Generally the punishments for possession of drugs from group 1, 1a, or 2 are more severe than groups 3 and 4. Even if you are found to have less than a gram of a group 1 drug, if convicted you would have a state jail felony on your record and you could be facing up to 2 years in state jail and possibly up to a $10,000 fine. Don't risk your freedom by not seeking the best possible legal representation!
